The loss, destruction, or theft of a Bill of Lading prevents the legitimate owner of the goods from collecting them at the destination. There are two distinct scenarios of Bill of Lading loss, each with its own procedure for resolution.
The most common scenario is the general loss of a Bill of Lading. This occurs when you lose all three original copies of either the Master Bill of Lading or the House Bill of Lading. In this case, you'll need to obtain a Letter of Indemnity (LOI).
A Letter of Indemnity is a document issued by you or your freight forwarder requesting the delivery of the cargo. Its primary purpose is to release the shipper from liabilities related to the consequences of delivering the cargo without presenting the original Bill of Lading.

The dispossessed owner of the Bill of Lading must approach a notary in the destination location specified in the original Bill of Lading. The owner must request the notary to ask the carrier not to deliver the goods to a third party until the Bill of Lading is restored. However, the dispossessed owner must provide sufficient evidence to prove their legitimate possession of the goods.
If the owner needs to receive the goods immediately, they can request this, but they must pay a security deposit to the notary equal to the value of the goods.
The notary will contact the carrier and require them to retain the goods if a third party comes to claim them. The notary will also notify the shipper and any endorsers (if they are different from the holder and have a known address). The notary will establish a 10-day period from the notification for all parties to submit any relevant arguments or objections.
After notifying the carrier, shipper, and endorsers about the request not to deliver the goods to third parties, the notary will publish this information in the Official State Gazette (Boletín Oficial del Estado).
From the date of this publication, there will be a one-month period for any third party to appear and express their opposition.
If no third party expresses opposition within the month, the notary will declare the amortization of the Bill of Lading and recognize the title to the dispossessed owner. At this point, the owner can finally demand the immediate withdrawal of their goods or retrieve the security deposit paid for the early delivery of the goods.
